Terms and Conditions
1. Scope and contracting party
These Terms apply to individual music productions ordered by consumers through Songdeal24. The contracting party is Rainbow Soundworks, a sole proprietorship, proprietor Alexander Maecke, Neuetorstraße 7, 31785 Hameln, Germany.
Orders are placed as a guest and only by adult consumers. The songdeal24.eu storefront is available exclusively to consumers in EU/EEA countries; contractual communication remains in English.
The Songdeal24 base product is intended for private use. Business productions, business audio branding and broader commercial rights are not part of this offer. Such projects can be requested through songnachmaß.de.
2. Formation of the contract
The product presentation is not a legally binding offer. By selecting “Place order and pay”, the customer submits a binding offer to enter into a contract.
Stripe or PayPal subsequently confirms the payment process. The contract is formed when Rainbow Soundworks accepts the order by sending the order confirmation after verified payment. A payment-provider return or success page alone does not change the payment status.
Immediately before the order, the scope, extras, total price, delivery time, payment methods and mandatory legal information are displayed.
3. Service
The base product comprises one personal song individually created from the customer briefing, at least three minutes long and typically about three to four minutes, delivery by email as an MP3, and delivery within no more than 24 hours after verified payment and receipt of a complete, technically usable briefing.
The only optional extras are a WAV file and prioritised 12-hour express production. Only the agreed final output is delivered; stems, project files, raw material, internal production files, prompts and rejected or alternative versions are not included.
4. Start and conditions of the delivery period
The delivery period starts only after payment has been confirmed, all mandatory information has been supplied, and the briefing is technically readable and usable. Incomplete, contradictory or incorrect information may extend the period reasonably by the time needed for clarification. Standard and express periods run on every calendar day, including weekends and public holidays.
5. Artistic discretion
The customer supplies names, occasion, memories, mood and wishes. Within that briefing, Rainbow Soundworks determines the composition, lyrics, arrangement, voice, instrumentation and production.
Artistic discretion remains. No particular subjective taste result, commercial success or exact similarity to a known artist is guaranteed. Artists or songs may be named as style references, but no identical melody, copied protected lyrics or deceptive exact artist imitation will be created.
6. Corrections
The base price does not include a regular revision round. Rainbow Soundworks will correct objective errors for which it is responsible, such as incorrectly transferred names or obvious technical file defects, at no additional cost.
Changes of taste, new details, a different genre, new lyrics, a different voice or a complete new production are not included. Mandatory statutory remedies remain unaffected.
7. Prices and payment
The introductory price is €19.90 from 1 September through 30 November 2026; the regular base price from 1 December 2026 is€24.90. The WAV upgrade is €2.90, and 12-hour express is €9.90. The server-calculated total and selected extras shown at checkout are decisive. All prices are gross prices and include 19% VAT.
Payment is made through Stripe or PayPal. Production starts only after verified payment.
8. Licence for private use
After full payment, the customer receives a simple, worldwide, perpetual and non-transferable licence solely for private purposes.
Private celebrations, birthdays, weddings, anniversaries, private playback and non-commercial, non-monetised personal social-media posts are permitted.
Advertising, business use, monetisation, resale, sublicensing, use as the customer’s own commercial music product and distribution through music or streaming distributors are prohibited. The licence does not create exclusivity in general musical elements. Rainbow Soundworks uses a customer song as a reference, sample or social-media content only with prior express consent. Commercial rights may be arranged separately through songnachmaß.de.
9. Customer materials and third-party rights
The customer confirms that submitted material may lawfully be used and does not infringe third-party rights. Requests must not reproduce protected third-party lyrics, deceptively imitate an artist, or contain unlawful, extremist, hateful, discriminatory, violence-glorifying or otherwise rights-infringing material.
Rainbow Soundworks may reject such or technically impossible orders. A paid order rejected before production starts is refunded in full to the original payment method without a handling fee. If a problem is identified during review, a lawful alternative may be offered or the order may be cancelled and refunded in full.
10. AI-assisted production
Technical or AI-assisted tools may be used for lyrics, composition, voice, production or editing. Creative selection, assembly and final review are carried out by Rainbow Soundworks. External production providers receive only the minimum derived material required, such as lyrics and a style description; email, payment data, full order history and unnecessary sensitive briefing data are not disclosed.
11. Liability
Liability is unlimited for intent and gross negligence and for injury to life, body or health. For a slightly negligent breach of an essential contractual obligation, liability is limited to foreseeable damage typical of the contract.
Any other mandatory statutory liability remains unaffected.
12. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules in the consumer’s country of habitual residence remain unaffected.
No special jurisdiction is agreed for consumers. If a provision is ineffective, the statutory rules apply in its place without affecting the remaining provisions.
